Overview
1. Legal Entity & DBA
The Food Safety Standard is a trade name / DBA operating under Transportation Consulting Group LLC, a Delaware limited liability company formed in 2024. All contracts, payments, receipts, and invoices will show as Transportation Consulting Group LLC DBA The Food Safety Standard. References to “Company,” “we,” “us,” or “our” mean Transportation Consulting Group LLC DBA The Food Safety Standard.
2. Products & Services
We provide 100% online food safety training and certification:
- Food Handler Card (ANAB / ANSI-accredited provider content)
- Food Protection Manager Certification (ANAB-CFP via NRFSP – 100% online via ProctorU live + AI proctoring, 24/7)
- HACCP, Allergen, Alcohol Server, and other compliance courses
- Corporate LMS, white-label, API, SMS renewal reminders, and digital wallet
All courses are digital, on-demand, available 24/7. Manager exams require laptop/desktop with webcam, microphone, stable internet, and government-issued photo ID per ANAB-CFP / ProctorU requirements.
3. Eligibility & State Compliance
Customer is responsible for verifying acceptance with their local health department (DE, PA, MD, NJ, Cecil County MD, Philadelphia County, etc.). Requirements vary: some jurisdictions require 70% to pass (MD), some require jurisdiction-specific cards. We maintain a quad-state compliance engine but do not guarantee acceptance by every local authority. No refund will be issued for failure to verify local requirements prior to purchase.
4. REFUND POLICY – PLEASE READ CAREFULLY
Our products are digital, immediate-access, and time-sensitive. By purchasing, you agree to this refund policy.
A. Food Handler & Ancillary Courses ($15-$599):
- Full refund if requested within 24 hours of purchase AND less than 10% of course content accessed AND no attempt at final exam AND certificate not issued.
- No refund after 24 hours, OR if 10%+ content accessed, OR if any exam attempt started, OR if certificate/card issued and downloaded. Immediate digital card issuance constitutes delivery of product.
- Duplicate purchase: Refund of second purchase if requested within 7 days and second course not accessed.
B. Food Protection Manager / CFPM via ProctorU ($99-$179):
- Course portion refundable within 24 hours if no ProctorU session scheduled and less than 10% accessed.
- ProctorU exam fee ($30-$35) is NON-REFUNDABLE once ProctorU session is scheduled, regardless of attendance, per ProctorU policy. We do not control ProctorU fees.
- No refund after exam is launched, completed, or if result (pass/fail) is issued, or if 5-year ANAB-CFP certificate is issued.
- No-show / late arrival / tech failure on customer side (no webcam, bad ID, bad internet, leaving room) = no refund. One free reschedule within 7 days if contacted before original exam time.
C. Corporate, White-Label ($3K/mo), API ($99/mo), LMS ($499/mo), SMS ($1/user/mo):
Monthly subscriptions non-refundable for current month. Cancel anytime for future months with 14-day written notice before renewal. Setup fees ($750 white-label) non-refundable after work has commenced. No refunds for API/SMS overages.
D. WIOA, EDGE, USDA, DSU, Grant-Funded Students:
If tuition paid via WIOA ITA voucher, Delaware DOL, or other grant, refund goes back to funding agency per 2 CFR 200, not to student. Student may still be liable to agency if they do not complete. No cash refunds to grant-funded students.
E. Chargebacks & Fraud:
Digital delivery with IP log, device fingerprint, completion time, and certificate download is proof of delivery. Filing a chargeback after accessing course or receiving card will result in certificate revocation and referral to county health department / employer notification of invalid card. Chargeback fee of $35 will be assessed.
5. Retake Policy
Food Handler: 3 attempts included per state law. Manager CFPM: 1 attempt included, retakes $35 plus new ProctorU fee. Retake must be taken within 30 days of first attempt.
6. Technical Requirements & No Refund for Customer Tech Issues
Customer must have: Laptop/desktop (no Chromebook for manager exam), Chrome/Edge latest, webcam, mic, 2 Mbps upload, quiet room, government ID. We offer free system check via ProctorU. No refunds for failure to meet tech requirements.
7. Certificates, Validity & Replacement
Handler: 3-year validity (per county). Manager: 5-year ANAB-CFP validity nationwide. Digital wallet included. Replacement card $10. Auto-renewal reminders at 60/30/7 days via SMS/email (opt-out anytime).
8. Privacy & Data
ProctorU sessions are recorded (video, audio, screen, keystrokes) per ANAB-CFP anti-cheating requirements. By scheduling exam, you consent to ProctorU privacy policy and recording. We store name, DOB, ID verification, exam results per ANAB-CFP 7-year retention rule.
9. Limitation of Liability
To the maximum extent permitted by Delaware law, Transportation Consulting Group LLC DBA The Food Safety Standard liability is limited to amount paid for course. We are not liable for lost wages, job loss, health department fines, or business closure.
10. Governing Law
This TOS governed by laws of State of Delaware, New Castle County. Disputes first via informal resolution to support@thefoodsafetystandard.com for 30 days, then binding arbitration in Wilmington, DE under AAA rules.
11. Changes to TOS
We may update TOS. Material changes to refund policy posted 14 days before effective date.
